These Terms & Conditions (“Terms”) govern your access to and use of the Total Concrete Care website (“Site”) and any products or services (“Services”) provided by 1247862 Alberta Ltd. (dba Total Concrete Care, “TCC,” “we,” “us,” or “our”). By visiting the Site, requesting a quote, or engaging our Services, you agree to be bound by these Terms. If you do not accept them, please refrain from using the Site or our Services.
1. Eligibility & Acceptance
You must be at least 16 years old and have legal capacity to enter contracts. By using the Site or placing an order, you represent that you meet these requirements and agree to comply with all applicable laws.
2. Scope of Services
TCC provides concrete‐treatment specification, material supply, and application services. The exact scope, price, schedule, and technical standards for each project are detailed in our written quotation or service agreement (“Contract”). In the event of conflict, the Contract prevails over these Terms.
3. Quotes & Orders
Quotes are valid for 30 days unless otherwise stated.
Acceptance must be in writing (email is sufficient).
We reserve the right to revise or withdraw a quote before your written acceptance.
4. Pricing & Payment
Prices are in Canadian dollars (CAD) and exclusive of GST/HST or other taxes, which will be added where applicable.
Unless stated otherwise, 50 % of the Contract price is due upon acceptance, with the balance payable upon substantial completion.
Overdue balances accrue interest at 1.5 % per month (18 % per year).
We accept EFT, major credit cards (processed via Stripe), and approved purchase orders.
5. Scheduling & Access
You are responsible for providing clear site access, utilities, and safe working conditions. Delays caused by site inaccessibility or unsafe conditions may result in additional charges and revised completion dates.
6. Client Responsibilities
You must:
1. Disclose any site hazards (e.g., moisture issues, chemical exposure).
2. Ensure substrates meet the preparation standards specified in the Contract.
3. Follow our cure times and return‐to‐service guidelines.
Failure to do so may void warranties and create additional costs.
7. Limited Warranty
TCC warrants that materials will be free from manufacturing defects and that application workmanship will meet the Contract specification for one (5) years from substantial completion, provided normal wear, maintenance, and use.
Exclusions: cracking due to substrate movement, abuse, chemical spill beyond product spec, improper client maintenance, or alterations by others.
Your sole remedy is repair or replacement of the affected area, at our discretion.
8. Disclaimer
Except as expressly stated, the Site and Services are provided “as is” without any other warranties—express or implied—including merchantability, fitness for a particular purpose, or non-infringement.
9. Limitation of Liability
To the fullest extent permitted by law, TCC’s total liability—whether in contract, tort, negligence, or otherwise—shall not exceed the amount you actually paid us under the relevant Contract. We are not liable for indirect, incidental, punitive, or consequential damages (e.g., lost profits, business interruption).
10. Indemnification
You agree to indemnify and hold TCC, its directors, employees, and contractors harmless from any third-party claims, damages, or expenses arising out of (a) your breach of these Terms or the Contract, or (b) unsafe site conditions not caused by us.
11. Intellectual Property
All content on the Site, including text, graphics, logos, and photos, is the property of TCC or its licensors and protected by Canadian and international copyright laws. You may not reproduce, distribute, or create derivative works without our written permission.
12. Links to Third Parties
The Site may reference external websites. TCC has no control over their content or privacy practices and accepts no responsibility for them.
13. Privacy
Your submission of personal information is governed by our Privacy Policy, which forms part of these Terms.
14. Governing Law & Dispute Resolution
These Terms and any Contract are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute shall be resolved exclusively in the courts of Alberta, sitting in Edmonton.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with a new “Last updated” date. Continued use of the Site or Services after such changes constitutes acceptance.
16. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
